A Lagos High Court has dismissed the preliminary objection filed by social media influencer Martins Vincent Otse, popularly known as VeryDarkMan (VDM), in a ₦1 billion defamation lawsuit brought against him by human rights lawyer Femi Falana (SAN) and his son, musician Folarin Falana (Falz). The court also imposed a ₦200,000 fine on VDM for his unsuccessful objection.
Background of the Case
The lawsuit stems from a video posted by VDM on his Instagram account (@verydarkblackman) on September 24, 2024. In the video, VDM allegedly made defamatory remarks about the Falanas, accusing them of obstructing justice in a case involving controversial figure Bobrisky. The Falanas claim that these statements were false and damaging to their reputations.

During the court session, Justice Fimisola Azeez ruled that VDM’s preliminary objection lacked merit. The objection challenged the court’s jurisdiction, arguing that the alleged defamation occurred outside Lagos State. However, the court found this argument unconvincing and ordered VDM to pay ₦100,000 each to Femi and Folarin Falana as costs. Additionally, the judge directed VDM to file his defense in the main suit without delay.
Claims by the Falanas
The Falanas are seeking ₦500 million each in damages, totaling ₦1 billion. They also request the court to declare VDM’s statements as defamatory and to issue a perpetual injunction preventing him from making similar statements in the future. Furthermore, they demand that VDM publish a public apology on his social media platforms and in a national newspaper.
The case has been adjourned to July 8, 2025, for further proceedings. VDM, who was absent during the court session, was represented by his counsel, Marvin Omorogbe. Femi Falana was represented by his legal team, while Falz appeared in person.
